Terms of Service

Welcome to Karaoke iQ ("we," "us," or "our"). The Service is operated by Benjamin Tittle, a sole proprietorship based in San Jose, California, USA, doing business as Karaoke iQ. These Terms of Service ("Terms") govern your access to and use of the website located at karaokeiq.com, including any related mobile web or progressive web applications, and our native Android and iOS apps distributed through Google Play and the Apple App Store (collectively, the "Service").

By accessing or using Karaoke iQ, creating an account, or subscribing to any paid plan, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not access or use the Service.

1. Eligibility

You must be at least 18 years old to create an account, purchase a subscription, or use Karaoke iQ. By accessing or using the Service, you represent and warrant that you are at least 18 years of age and possess the legal capacity to form a binding contract.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@karaokeiq.com if you suspect any unauthorized access or security breach regarding your account.

2. Service Tiers & Usage Limits

Karaoke iQ provides both a Free Tier and an optional paid subscription tier ("Karaoke iQ Pro"):

3. Subscriptions, Billing & Cancellation

Recurring Subscription: Karaoke iQ Pro is offered on an automatically recurring subscription basis, available as an annual plan ($14.99/year) or a monthly plan ($2.99/month). How you are billed depends on where you subscribe: purchases on karaokeiq.com (web or installed PWA in the browser) are processed by our payment partner Stripe; purchases in our iOS app are processed by Apple In-App Purchase; purchases in our Android app are processed by Google Play Billing. We do not offer a lower price for the same subscription by steering you to an off-app payment method where the platform requires in-app purchase.

Why Pro costs money: Pro pays for ongoing cloud sync, search, hosting, payment processing, and an ad-free experience. You can pay for it as a subscription or, where offered, once with Lifetime Pro. Pricing is intended to stay affordable for regular karaoke singers; the free tier remains available with usage limits described elsewhere in these Terms.

Automatic Renewal: By purchasing a Pro subscription, you authorize recurring charges through the billing platform you used (Stripe, Apple, or Google) at the start of each billing cycle (monthly or annually) until you cancel in that platform's subscription settings.

Cancellation: If you subscribed via Stripe on the web, open Settings & Profile → Manage billing to use the Stripe Customer Portal to cancel or update payment methods. If you subscribed via the App Store or Google Play, you must cancel in your Apple ID or Google Play account subscription settings—Karaoke iQ cannot cancel store subscriptions for you. When canceled, Pro access typically remains through the end of the current paid period, and no further renewal charges should be made by that platform. Deleting your Karaoke iQ account cancels a Stripe subscription automatically, but does not cancel an App Store or Google Play subscription.

App Store & Google Play Purchases: Purchases made in our iOS or Android app are also subject to the terms of the store you bought through (Apple's Media Services Terms or the Google Play Terms of Service). The store processes the payment, handles renewals and refund requests under its own policies, and we never receive your card number. Your Pro access is tied to your Karaoke iQ account; if you sign in on another device, tap Restore purchases on the Upgrade to Pro screen if Pro does not appear right away.

Lifetime Pro: Where offered, Lifetime Pro is a one-time purchase that does not renew. It unlocks the Pro features of the Service for your Karaoke iQ account for as long as the account exists and the Service is operated, is tied to that account, and cannot be transferred. "Lifetime" means the operating life of the Service, not the life of the purchaser or of any other person. Buying Lifetime Pro does not cancel an existing Pro subscription; cancel that separately as described above. If a Lifetime Pro payment is refunded or reversed, Lifetime Pro is removed from the account.

Refund Policy & Termination for Cause: Except as explicitly required by applicable law or the policies of Apple or Google for store-billed purchases, subscription fees are non-refundable. If your account, Pro subscription, or access to the Service is suspended, restricted, or permanently terminated due to a violation of these Terms (including, but not limited to, harassment, stalking, spam, hate speech, abusive messaging, or catalog vandalism), you will immediately forfeit any remaining time on your active subscription and will not be entitled to any refund, credit, or prorated reimbursement.

4. User-Generated Content & Public Database Contributions

Users may contribute public content to the Karaoke iQ database, including song metadata, venue listings, karaoke schedules, tags, and performer profiles ("User Content"). By submitting User Content, you agree to the following:

• Accuracy & Verification

  You affirm that you have personally verified the accuracy of any venue, schedule, or cruise ship fleet information submitted via official channels.
• Prohibition of Illegal & Unlicensed Activity

  Public venue listings, notes, schedules, and song contributions must not reference, facilitate, or promote unlawful activity, copyright infringement, or the use of software or media sources unlicensed for commercial public performance (including, but not limited to, unauthorized consumer streaming playback in commercial venues).
• Licensing of Public Content

  You grant the legal owner and operators of karaokeiq.com a perpetual, worldwide, non-exclusive, royalty-free license to use, display, index, adapt, and distribute any public song, venue, or tag information you contribute.

Account deletion & shared catalog: You can delete your account at any time from Settings & Profile → Delete account (steps and details at karaokeiq.com/delete-account). We handle your personal data as described in our Privacy Policy. Public venue contributions stay in the directory for other singers. Songs you originally added are handed to another singer who also uses them (logged them or has them in their library), or removed if nobody else does, so the shared catalog stays accurate without keeping you as owner.

Copyright Complaints (DMCA): We respect copyright and respond to notices of claimed infringement under the U.S. Digital Millennium Copyright Act. If you believe content on the Service (such as a profile photo, note, or venue listing) infringes your copyright, send a notice to our designated agent with: (1) your physical or electronic signature; (2) a description of the copyrighted work; (3) where the material appears on the Service, specific enough for us to find it (for example, a link); (4) your name, address, telephone number, and email; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for the owner.

Designated agent: Benjamin Tittle, Karaoke iQ. Email: support@karaokeiq.com (subject line "DMCA Notice"). If we remove material because of a notice, we will try to tell the person who posted it. They may send a counter-notice to the same agent with their signature, identification of the removed material and where it appeared, a statement under penalty of perjury that they believe in good faith it was removed by mistake or misidentification, and their name, address, and telephone number with consent to the jurisdiction of the federal court for their address (or, outside the U.S., any judicial district where we may be found). We may restore the material 10 to 14 business days after the counter-notice unless the complainant tells us they have filed a court action. We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

5. Intellectual Property, Trademarks & Copying

Proprietary Ownership & Trademarks: The name Karaoke iQ™, the Karaoke iQ logo, our custom icons, slogans, visual brand identity, domain names, and trade dress are common law and statutory trademarks and service marks of the platform operator. You may not use, register, or claim rights in any trademark, business name, domain name, or social media handle that is identical or confusingly similar to "Karaoke iQ" in a way likely to confuse people about who runs it or whether we endorse it.

Software & Design: The Service's software, source code, visual design, user interface layouts, written content, and distinctive look and feel (including the presentation of features such as Wishlist and Sing Soon, the full-screen Show KJ display, and Cruise Ship Mode) are owned by the operator of Karaoke iQ and are protected by United States and international copyright, trademark, trade dress, and unfair competition laws, to the extent those laws apply.

YouTube Playlist Import: Importing a YouTube or YouTube Music playlist uses YouTube API Services. By using that feature you agree to be bound by the YouTube Terms of Service. See our Privacy Policy and the Google Privacy Policy for how that data is handled.

Third-Party Trademarks & Platform Disclaimers: KaraFun® is a registered trademark of Recisio SAS. Spotify® is a registered trademark of Spotify AB. Apple Music® is a registered trademark of Apple Inc. YouTube Music™ and YouTube™ are trademarks of Google LLC. Karaoke iQ is an independent service operated by Benjamin Tittle and is not affiliated with, authorized by, maintained, sponsored, or endorsed by Recisio SAS, Spotify AB, Apple Inc., Google LLC, or any of their respective affiliates or subsidiaries. All other trademarks, service marks, trade names, and logos appearing on the Service are the property of their respective owners. Any reference to, integration with, or deep-linking to third-party services is strictly for user convenience and nominative reference to denote software compatibility.

6. Privacy of Personal Notes & Private Venues

Information you explicitly mark as private—such as private song notes, personal song ratings, preferred key changes, private venue names, and private venue notes—is intended for your personal use and is not shown to other singers or in activity feeds.

Performances logged at private venues are not shown to other users: they are excluded from public performer profiles, public venue pages, friends' activity feeds, and notifications. Platform administrators may access account data when necessary for technical support, troubleshooting, safety, or platform security, and we may disclose information where the law requires it, as described in our Privacy Policy. 7. Prohibited Conduct, Messaging, Squad Chats & Anti-Stalking Policy

You agree not to use the Service, including performer profiles, 1-on-1 direct messaging, squad group chats, shared song/venue cards, friend connections, location tools, or performance logs, to stalk, monitor, surveil, harass, threaten, spam, intimidate, phish, or track the physical location or movements of any person. Direct messaging and squad group creation are restricted to accepted friend connections; sending abusive, defamatory, sexually explicit, fraudulent, or harassing messages is strictly prohibited.

Group chats ("Squad Chats") are limited to up to 15 accepted friends. All group members can view member stage names, send messages, share interactive song/venue cards, and rename the group. Any participant may leave a group chat or unfriend another user at any time with immediate effect; unfriending ends direct messaging and prevents further contact through accepted-friend features.

Blocking & Reporting: You can block another user from their profile, a message, or a venue's Recent Singers list. Blocking ends the friendship and stops friend requests, direct messages, props, and group invites between you, and hides their messages from you in squad chats you share. The blocked person is not told. You can unblock at any time in Settings & Profile → Preferences & Privacy. You can report an abusive message from the conversation, or email support@karaokeiq.com. You agree not to create additional accounts or use other means to get around a block, a suspension, or a ban.

No Duty to Pre-Screen or Monitor: While group and direct messages are programmatically scanned for malicious links and phishing threats, you acknowledge and agree that Karaoke iQ has no obligation to pre-screen, eavesdrop on, or proactively monitor private user-to-user communications in real time. We rely on users to report inappropriate behavior, and we reserve the right to investigate reports, access audit logs, and remove content or ban users that violate these Terms. We cooperate fully with law enforcement in matters involving imminent physical harm, credible threats of violence, or child exploitation.

8. Assumption of Risk & Real-World Offline Interactions

Karaoke iQ is an organizational tool for song repertoires and crowd-sourced venue schedules. We do not screen users or conduct criminal background checks. You are solely responsible for your personal safety, offline interactions, and meetings with other users.

To the maximum extent permitted by law, you agree that Karaoke iQ, its owners, and operators assume no liability or responsibility for any acts, omissions, disputes, harassment, physical harm, emotional distress, or unlawful conduct of any user or third party occurring at any listed venue or real-world karaoke event.

9. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. Real-world karaoke event schedules, hosting days, and operating hours are subject to frequent change by venue management without notice. While our community works to keep information current, Karaoke iQ makes no guarantee that any venue's listed karaoke schedule or equipment will be active upon arrival.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARAOKE IQ AND ITS OWNER AND OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (FOR LIFETIME PRO, THE PRICE YOU PAID FOR IT) OR (B) US$30. Some jurisdictions do not allow certain of these limits, so they apply to you only to the extent the law allows.

Discontinuation of the Service: We may discontinue the Service, or any paid plan including Lifetime Pro, at any time. Before we do, we will give at least 90 days' notice in the app or by email, and during that period you can download your songs, performances, and venues from Settings & Profile → Preferences & Privacy → Data Export. If we discontinue the Service within 12 months of your Lifetime Pro purchase, we will refund a prorated share of the price, based on the months remaining in that 12-month period. Otherwise, Lifetime Pro and prepaid subscription time are not refundable on discontinuation, except where required by applicable law or by Apple's or Google's policies for store-billed purchases.

Transfer of the Service: We may assign or transfer these Terms, the Service, and your account, including any Lifetime Pro or subscription entitlement, to a successor operator, affiliate, or acquirer, who will then be bound by these Terms. You may not assign your rights under these Terms without our written consent.

Indemnification: To the extent the law allows, you agree to defend, indemnify, and hold harmless Karaoke iQ and its owner and operators from any claims, losses, liabilities, and reasonable costs (including reasonable attorneys' fees) brought by a third party that arise from content you submit, your use of the Service in violation of these Terms, or your violation of any law or the rights of another person.

10. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last Updated" date above. For material changes, we will notify you in the app or by email at least 30 days before they take effect. Changes required by law, or that address security or safety, may take effect sooner, and changes that only add new features or clarify wording take effect when posted. If you continue to use the Service after a change takes effect, the revised Terms apply to you. If you do not agree to them, you can stop using the Service and delete your account, and cancel any subscription as described in Section 3.

11. Governing Law & Dispute Venue

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Except where prohibited by applicable law, you agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.

12. General

Entire agreement: These Terms, together with our Privacy Policy and any terms shown to you when you buy a paid plan, are the entire agreement between you and Karaoke iQ about the Service and replace any earlier agreements on that subject.

Severability: If a court finds any part of these Terms unenforceable, that part will be enforced to the maximum extent allowed and the rest of these Terms will stay in effect.

No waiver: If we do not enforce a provision of these Terms right away, we have not given up the right to enforce it later.
